Michigan Proposal 2006-04: Eminent Domain and Takings

Proposal 4 on Michigan ballot this November is aimed squarely at curtailing the aftereffects of the Kelo decision. Long story short, Prop 4 will tighten the definition of a blighted property, require 125% of market value be paid to the property owner, and burden of proving blightedness rests on the municipality, not the property owner.
